Welcome to Rebound Central Plateau Limited (hereinafter referred to as "the Company," "we," "our," or "us"). By renting any of our inflatable bounce houses, you (the "Renter," "Customer," "you," or "your") agree to the following Terms and Conditions. Please read them carefully before you confirm any booking with us.
1. Rental Agreement
This agreement constitutes a legal contract between you (the Renter) and the Company. By completing the rental process, you agree to comply with these Terms and Conditions in full.
2. Eligibility
- The Renter must be at least 18 years old.
- The Renter must provide accurate information, including delivery address, contact details, and event specifics at the time of booking.
3. Rental Duration
- The rental period begins when the bounce house is delivered to the designated site and ends when it is picked up within the same day.
- Extended rental periods are subject to availability and additional charges.
4. Delivery, Setup, and Pickup
- The Company will deliver and set up the bounce house at the location specified by the Renter.
- The Renter must ensure that the delivery location is suitable, with adequate space, access, and safety considerations.
- The Renter is responsible for ensuring that the area is clear of any hazards such as sharp objects, overhead obstructions, uneven surfaces, or nearby obstructions e.g. decking, fences.
- The Renter will clarify if there are underground sprinkler systems.
- Pickup will be arranged at the time of drop off and agreed pickup concludes the rental period.
5. Rental Fees and Payment
- The Renter agrees to pay the deposit amount at the time of booking or as outlined in the invoice.
- Payment of balance is due payable at anytime up to bounce house delivery and must be paid in full before bounce house set up.
- Any additional charges for overtime use, damages, or cleaning will be charged to the Renter.
- Payments can be made via credit card, direct deposit, or any other accepted payment method.
6. Damage and Cleaning
- The Renter is responsible for any damage to the bounce house during the rental period, whether caused by misuse, negligence, or accidents.
- If the bounce house requires additional cleaning due to excessive dirt, spills, or damage, the Renter will incur additional cleaning fees.
- The Company reserves the right to charge for the cost of repairs or replacement if the bounce house is returned in a damaged condition or condition less than the beginning of the hire period.
7. Cancellation and Rescheduling
- Cancellations made up to the day before a booking or more will receive a full refund.
- Cancellations on the day of booking will not receive a refund (pending exceptional circumstances at the judgement of the Company.)
- Rescheduling requests will be accommodated based on availability.
8. Weather and Safety Concerns
- In the event of unsafe weather conditions (e.g., heavy rain, wind gusts exceeding 30 km/h), the Company reserves the right to cancel or postpone the rental.
9. Liability Waiver and Release
- By renting a bounce house/s from the Company, the Renter agrees to the following terms regarding liability:
- Assumption of Risk: The Renter acknowledges that the use of a bounce house involves inherent risks, including but not limited to falls, collisions, and injuries. The Renter voluntarily assumes all risks associated with the use of the bounce house.
- Indemnification: The Renter agrees to indemnify and hold harmless the Company, its employees, agents, and contractors from any claims, demands, damages, losses, or expenses arising out of or in connection with the use of the bounce house, including but not limited to personal injury (physical or otherwise), property damage, or any legal action.
- Release of Liability: The Renter, on behalf of themselves, their guests, and any participants, releases in full the Company from all liability, claims, damages, and actions arising from the rental or use of the bounce house. This release includes, but is not limited to, any injury, loss, or death that may occur during the rental period.
10. Medical Conditions
- The Renter affirms that they, and all users of the bounce house, are in good health and have no medical conditions that would impair their ability to use the inflatable safely. If any participant has a pre-existing medical condition, the Renter is responsible for ensuring that the participant is medically fit to use the bounce house. Any users with pre-existing joint, spinal or neck concerns or injuries should refrain from any bounce house use.
11. Right to Refuse Service
- The Company reserves the right to refuse service or terminate the rental agreement at any time if the Renter or any participant is found to be violating these Terms and Conditions or engaging in unsafe or disruptive behavior.
12. Personal Injury and Medical Emergencies
- The Company is not responsible for any personal injury or medical emergencies that may occur during the rental period. The Renter is responsible for ensuring that all participants understand the risks associated with bounce house use and for providing adequate and responsible supervision.
13. Photographs and Promotional Use
- By accepting these Terms and Conditions, the Renter agrees that the Company may take photographs of the rented bounce house and event at their nominated location and use them for marketing, advertising, or promotional purposes. If you do not wish to have photographs taken, please inform us prior to the rental period.
14. Governing Law
- This Agreement is governed by and construed in accordance with the laws of New Zealand. Any disputes arising out of or related to this Agreement shall be resolved in the courts of New Zealand.
